   4 READ THE TERMS OF USE CAREFULLY BEFORE INSTALALTION OF THIS SOFTWARE. BY

   7 1. LICENSE TO USE. ComArch grants you a non-exclusive and non-transferable
   8 license for the internal use only of the accompanying software and
   9 documentation and any error corrections provided by ComArch (collectively
  10 "Software"), by the one user.

  12 2. RESTRICTIONS. Software is confidential and copyrighted. Title to Software
  13 and all associated intellectual property rights is retained by ComArch
  14 and/or its licensors. Unless enforcement is prohibited by applicable law,
  15 you may not modify, decompile, or reverse engineer Software. You acknowledge
  16 that Software is not designed, licensed or intended for use in the design,
  17 construction, operation or maintenance of any nuclear facility. Sun ComArch
  18 disclaims any express or implied warranty of fitness for such uses. No
  19 right, title or interest in or to any trademark, service mark, logo or trade
  20 name of ComArch or its licensors is granted under this terms of use.

  23 3. DISCLAIMER OF WARRANTY. UNLESS SPECIFIED IN THIS AGREEMENT TERMS OF USE,
  24 ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING
  25 ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR
  26 NON-INFRINGEMENT ARE DISCLAIMED, EXCEPT TO THE EXTENT THAT THESE DISCLAIMERS
  27 ARE HELD TO BE LEGALLY INVALID.

  29 4. LIMITATION OF LIABILITY. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT
  30 WILL COMARCH OR ITS LICENSORS BE LIABLE FOR ANY LOST REVENUE, PROFIT OR
  31 DATA, OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE
  32 DAMAGES, HOWEVER CAUSED REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT
  33 OF OR RELATED TO THE USE OF OR INABILITY TO USE SOFTWARE, EVEN IF COMARCH
  34 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event will

  36 negligence), or otherwise, exceed []. The foregoing limitations will apply

  39 5. Termination. This license is effective until terminated. You may
  40 terminate this license at any time by destroying all copies of Software.
  41 This license will terminate immediately without notice from ComArch if you
  42 fail to comply with any provision of this license. Upon Termination, you
  43 must destroy all copies of Software.

  45 6. Export Regulations. All Software and technical data delivered under this
  46 terms of use are subject to Polish export control laws and may be subject to
  47 export or import regulations in other countries. You agree to comply
  48 strictly with all such laws and regulations and acknowledge that you have
  49 the responsibility to obtain such licenses to export, re-export, or import
  50 as may be required after delivery to you.

  52 7. Governing Law. Any action related to this license will be governed by
  53 Polish Law.

  55 8. Severability. If any provision of this terms of use is held to be
  56 unenforceable, this terms of use will remain in effect with the provision
  57 omitted, unless omission would frustrate the intent of the parties, in which
  58 case this terms of use will immediately terminate.

  60 9. Integration. This document is the entire  agreement between you and
  61 ComArch relating to its subject matter. It supersedes all prior or
  62 contemporaneous oral or written communications, proposals, representations
  63 and warranties and prevails over any conflicting or additional terms of any
  64 quote, order, acknowledgment, or other communication between the parties
  65 relating to its subject matter during the term of these terms of use. No
  66 modification of this Agreement will be binding, unless in writing and signed
  67 by an authorized representative of each party.
